Divergent Graveyard LLC ("DIGY," "we," "us," or "our") operates the DIGY mobile application (the "App"). This Privacy Policy explains how we collect, use, disclose, and protect your information when you use our App.

By using the App, you agree to the collection and use of information in accordance with this policy. If you do not agree with our policies and practices, do not use the App.

2.1 Personal Information You Provide

When you use the App, we collect the following information:

• Profile Photos: Photos you upload for your profile
• Item Photos: Photos of items you list for trade or sale
• Messages: Communications between you and other users through our in-app messaging system

2.2 Location Information

We collect your precise location data to show you items and users in your area. Location data is stored and used to facilitate local trading. You can opt out of location sharing in your device settings, though this may limit App functionality.

2.3 Automatically Collected Information

• Device Information: Device type, operating system, unique device identifiers
• Usage Data: App features used, pages viewed, time spent in the App
• Log Data: IP address, browser type, access times

3. How We Use Your Information

We use your information for the following purposes:

• To provide and maintain the App's functionality
• To show you nearby users and their inventory
• To facilitate communication and trades between users
• To send you push notifications about offers, messages, and App updates
• To monitor for suspicious activity and flag potentially prohibited items
• To enforce our Terms of Service and prevent fraud

4. Third-Party Services

4.1 Authentication

Apple Sign-In, Google Sign-In, and Facebook Login for account authentication. These services may collect information as described in their respective privacy policies.

4.2 Firebase

5. Message Monitoring and Storage

Important: Messages sent through the App are monitored for safety and compliance purposes. We may review messages flagged by our automated systems or reported by users. Messages are stored for 60 days and then automatically deleted.

6. Information Sharing

We do not sell your personal information. We may share your information in the following circumstances:

• With Other Users: Your profile information, inventory, and location (general area) are visible to other users to facilitate trading
• Service Providers: Third-party companies that help us operate the App (Firebase, authentication providers)
• Legal Requirements: When required by law, court order, or to protect our rights and safety
• Business Transfers: In connection with a merger, acquisition, or sale of assets

7. Data Security

We implement reasonable security measures to protect your information. However, no method of transmission over the internet or electronic storage is 100% secure. While we strive to protect your personal information, we cannot guarantee its absolute security.

8. Your Rights and Choices

8.1 Account Deletion

You can delete your account at any time through the App settings. Upon deletion, your data will be retained for 60 days to comply with legal obligations and resolve disputes, then permanently deleted.

8.2 Location Settings

You can opt out of location sharing through your device settings. Note that this may limit your ability to use certain App features.

8.3 Marketing Communications

You can opt out of promotional notifications through the App settings or device notification settings.

9. California Privacy Rights (CCPA/CPRA)

If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA):

• Right to Know: You can request information about the personal information we collect, use, and share
• Right to Delete: You can request deletion of your personal information
• Right to Opt-Out: We do not sell personal information, so no opt-out is necessary
• Right to Non-Discrimination: We will not discriminate against you for exercising your privacy rights

10. California Online Privacy Protection Act (CalOPPA)

Under CalOPPA, we agree to the following:

• Users can visit our App anonymously (browsing without an account is not available; account required)
• This Privacy Policy is linked on our home page and app store listing
• You will be notified of Privacy Policy changes via email or in-app notification
• You can change your personal information by contacting us at support@digy.gay

Do Not Track Signals: We do not currently respond to Do Not Track (DNT) signals as there is no industry standard for how to respond to such signals.

11. GDPR Compliance (For EU Users)

Although DIGY is currently available only in the United States, if you are located in the European Union, you have the following rights under the General Data Protection Regulation (GDPR):

• Right to Access: Request a copy of your personal data
• Right to Rectification: Request correction of inaccurate data
• Right to Erasure: Request deletion of your data
• Right to Restrict Processing: Request limitation on how we use your data
• Right to Data Portability: Currently not available, but you can request data deletion
• Right to Object: Object to processing of your personal data
• Right to Withdraw Consent: Withdraw consent for data processing at any time

Legal basis for processing: We process your data based on your consent, contract performance, legal obligations, and legitimate interests in providing and improving our services.

12. Children's Privacy

The App is not intended for users under 18 years of age. We do not knowingly collect personal information from children under 18. If we discover that we have collected information from a child under 18, we will delete it immediately. If you believe we have collected information from a child, contact us atsupport@digy.gay.

13. Data Retention

We retain your information as follows:

• Account Data: Until you delete your account, plus 60 days
• Messages: 60 days from the date sent
• Transaction History: Retained for legal and dispute resolution purposes
• Log Data: Typically retained for 90 days

14. International Users

The App is operated in the United States and is currently only available to U.S. users. Your information will be stored and processed in the United States, which may have different data protection laws than your country of residence.

15. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of changes by:

• Posting the new Privacy Policy on this page
• Updating the "Effective Date" at the top
• Sending you an email notification or in-app notification

Your continued use of the App after changes constitutes acceptance of the updated policy.
